OPTION TO PURCHASE

BE IT KNOWN, That on this ____ day of ______________ in the year of Our Lord Two Thousand ___________ (200___).
PERSONALLY CAME AND APPEARED:
Amaris Isle Plantation LLC, herein represented by Kirk D. St. Pierre, President, (Seller), who declared that for and in consideration of the price and sum of __________________________________________________________________ ($________________) Dollars cash, which is ten (10%) per cent of the purchase price of the subject property, as a deposit, receipt of which is hereby acknowledged, it does hereby grant unto _________________________________________________________________________, (Purchaser) for a period of time extending from the execution of this Option to Purchase until thirty (30) days after the completion of the construction of Amaris Isle Plantation, Grand Isle, Louisiana, and the final approval of all regulatory bodies of the Parish of Jefferson, Louisiana and the Town of Grand Isle, Louisiana, and subject to the conditions hereinafter set forth, the exclusive right, privilege or option to purchase for the price and sum of ____________________________________________________ ($_________________) Dollars Cash, the following described property, to-wit:
Lot ________ of Amaris Isle Plantation as identified on a survey plat showing the preliminary subdivision layout for Amaris Isle Plantation, Grand Isle, Louisiana, prepared by Picciola & Associates, Inc. under date of June 2, 2003, which survey plat is subject to amendment as required for final approval of said subdivision.

Seller will make available at the closing of the subject property a survey plat of the subject property approved by all necessary authority to be used for the Act of Sale if this option is exercised by Purchaser.
For Purchaser to exercise the option herein granted, it shall send a certified letter to Seller giving Seller notice of the intent of Purchaser to exercise the option addressed to Seller c/o Amaris Isle Plantation, P. O. Box 1464, Larose, LA 70373 prior to the expiration date of this option. The Act of Sale of the hereinabove described property shall be passed before Purchaser’s Notary within fifteen (15) days of the date of the receipt by Seller of said certified letter.
When the Act of Sale is actually passed within said period, the sum of ____________________________________________________________________ ($______________) Dollars representing the ten (10%) per cent deposit shall be applied to the total purchase price of ___________________________________________________________________ ($_______________) Dollars and the balance thereof shall be paid in cash at the time of the passing of the Act of Sale. If this option is not properly exercised within the time period allowed for the execution of this option, or the Act of Sale is not passed, because of any default by Purchaser within the time period for the notifying of Purchaser's intent to purchase the property and the date of the Act of Sale, Purchaser shall have no right or claim whatsoever to the said sum of ________________________________________________________ ($______________) Dollars which represents the ten (10%) per cent deposit or any part thereof, which said sum shall at that time become the property of Seller as liquidated damages without demand or the necessity of placing Purchaser in default, both of which is being hereby expressly waived.
It is further understood and agreed that time is of the essence of this contract and that all rights of Purchaser herein shall cease and terminate if notice of Purchaser’s intent to exercise this option has not been sent within the time period set forth above for the execution of this option. All expenses incidental to the passing of the Act of Sale are to be paid by Purchaser.
